An Act Enforcing Trafficking of Women and Children And Forced Labour In The Republic Of Meldonia

Article 1. Anti-human Trafficking in the Republic of Meldonia

Section 1. This Act specifically protects women and children found to be victims of human trafficking.

Section 2. This Act adopts the definition of trafficking in line with the description specified in the UN
4
Protocol to Prevent, Suppress and Punish Trafficking in Persons, especially Women and Children.

Section 2.1 A foreigner or a migrant who is found to be a victim of cross-border trafficking will be held
6
under the supervision of Ministry of Immigration of the Republic of Meldonia.

Section 2.2 Any woman or child found to be a victim of cross-border trafficking will be automatically
8
emancipated from the parental rights of the individual holding responsibility of the victim provided that
9
the state establishes that they were the perpetrators of the act.

Section 2.3 The victim charged with a crime to which she is allegedly been trafficked shall enjoy
11
immunity of such crimes.

Section 2.5 Whereas reasonable consideration is given by the state, temporary or permanent
13
Residence on the Republic of Meldonia would be given provided that the victim meet these set of
14
Conditions

(1) whereas it is seen, on reasonable grounds, to compromise the safety of the trafficked
16
(2) whereas full cooperation is given as to giving testimonies and other means to deal with the
17
country’s issues on human trafficking.

Section 3. This Act will also be implementing the Protocol against the Smuggling of Migrants by
20
Land, Sea and Air.

Section 3.1 The act will be following the main aims of the said protocol without compromising the
22
basic human rights of the migrants.

Section 3.2 This Act shall thwart and fight the occurrence of smuggling of immigrants by
24
(1) improving security and monitoring of commercial carriers and other means of transport
25
to the country;
26
(2) sanctioning the Ministry of Immigration to improve the quality of the security rendered in
27
monitoring documents needed for identification.

Section 3.3 Closer cooperation between neighboring countries will be made through
29
(1) maintaining a constant exchange of data and intelligence;
30
(2) establishing a system that will effectively verify the identification documents of migrants;
31
(3) collaborate with regards to training the immigration officers handling the smuggling of migrants;
32
(4) share technologies monitoring the movement of people in and out of borders;
33
(5) determining the social and economic origins of migration.

Article 2. Forced Labor in the Republic of Meldonia

Section 1. This Act protects all individuals under employment within the borders of the Republic of

Meldonia

Section 2. The state regards the International Labor Organization’s Convention No. 105: Convention
38
Concerning Abolition Of Forced Labor and Forced Labour Convention, 1930 (No. 29) as its
39
foundation on its principles on forced labor.

Section 2.1. The Republic of Meldonia recognizes the anti-slavery movement espoused by the ILO
41
Section 2.2 The state recognizes the rights of the individual as they are forced to deliver some form
42
of labor for another party.

Section 2.4 The exemptions on this section will share the terms included in Article 2(2) of Convention
44
No. 29 which includes:

(1) Military Service
46
(2) Civic Obligation
47
(3) Prison Labor
48
(4) Emergency Situations
49
(5) Communal Service

Section 3. The terms and requirements indicated in these articles are to be implemented by the

Ministry of Immigration of the Republic of Meldonia.
